Beta Service Notice
Sentimentary is operating as an open beta while Sentimentary Corporation is being incorporated. During this period the service is operated by Laurel Pines Limited Company, doing business as THEBIZFIXER (“THEBIZFIXER,” “Laurel Pines LC,” “we,” “us,” or “our”). Features may change substantially, the service is provided for evaluation without guaranteed continuity or uptime, and your account and data may transition to Sentimentary Corporation at launch under §12 below.
1. Acceptance of Terms
By creating an account, submitting a waitlist email, or using the Sentimentary beta research platform (the “Service”) in any way, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
- You must be at least 13 years old to create an account.
- Where a GDPR member state has set the digital-consent age above 13 (up to 16 under Article 8 GDPR), users aged 13–15 require verifiable parental or guardian consent, which we collect at account creation.
- By continuing past this section, you acknowledge that the Service is operating as a beta and that §2 below applies.
2. Beta Service Notice
The Service is provided during the beta for evaluation and feedback. You acknowledge and agree that:
- features, tiers, pricing, availability, and data structures may change substantially and without notice;
- there is no guarantee of continuity, uptime, or data preservation during the beta period;
- we may reset, migrate, or delete data at the end of the beta period, subject to the 30-day notice window described in §12 and in §10A of the Privacy Policy; and
- the Service transitions to Sentimentary Corporation at launch, at which point the Sentimentary Corporation Terms of Service will supersede these Terms.
3. Description of Service
Sentimentary is a sentiment research platform. You configure a research project and run snapshots against public web sources; the Service extracts quoted content, computes sentiment polarity and related metrics, and returns sourced, traceable results you can explore and export.
4. Account Registration and Security
- You must provide accurate, current, and complete information when you register and keep that information up to date.
- One account per person. You are responsible for safeguarding your credentials and for all activity that occurs under your account.
- We may suspend or terminate accounts that violate these Terms, our acceptable use policy (§6), or applicable law.
5. Subscription Tiers and Billing
- Beta only. All access during the beta is free. No payment processing is active and we do not collect payment information.
- Launch. Subscription tiers (Curious free, Investigator $50/mo, Researcher $1,500/mo, Institutional custom), billing through Stripe and Alguna, auto-renewal, cancellation, and refund terms will be introduced in the Sentimentary Corporation Terms of Service at launch and will not apply retroactively to your beta use.
6. Acceptable Use Policy
You agree not to:
- use the Service for any illegal purpose, or to extract content in violation of applicable law;
- reverse engineer, decompile, or attempt to derive the source code of the Service, the scoring engine, or the lexicons;
- resell, sublicense, or commercially redistribute the Service or its outputs without our prior written consent;
- abuse the Service’s infrastructure, circumvent rate limits or billing controls, or interfere with other users;
- use the Service to harass, deceive, or harm any individual or group, or to violate the terms of the third-party platforms from which content is extracted.
6A. Third-Party Source Compliance and DMCA
The Service extracts quoted content from public web sources that you direct it to observe.
Your representations
By configuring a snapshot, you represent and warrant that:
- your research targets and snapshot configurations do not violate the terms of service of the platforms you direct us to observe (for example, Discord, Reddit, Telegram, X, and other connected channels);
- where consent is required under the source platform’s terms or applicable law, you have obtained that consent;
- you preserve author anonymization as configured, and you will not use extracted data to identify, harass, or target individual authors.
Our right to reject or remove content
We reserve the right, in good faith, to reject or remove snapshots, extractions, or exports that target sources we determine to be non-compliant with third-party platform terms, applicable law, or our own policies.
DMCA takedown process
We comply with the Digital Millennium Copyright Act (17 U.S.C. §512). Copyright holders who believe content on the Service infringes their rights may submit a takedown notice to our designated agent at [email protected] containing the information required by §512(c)(3). We will respond per §512 and will terminate the accounts of repeat infringers.
7. Intellectual Property
- Our proprietary IP. Laurel Pines Limited Company owns the proprietary sentiment scoring engine, lexicons, and scoring pipeline used to operate this beta Service. Your account does not grant you any right, title, or interest in these assets.
- Your research configurations. You retain ownership of the project configurations and research questions you submit. You grant us a non-exclusive, worldwide, royalty-free license to host, copy, and process your configurations solely to operate the Service on your behalf.
- Extracted data. Quoted content extracted from public sources is licensed to you for in-platform research use, subject to the representations in §6A and to the rights of the original authors and source platforms.
- No reverse engineering. You agree not to reverse engineer, attempt to train a competing model on, or otherwise derive the proprietary scoring engine, lexicons, or algorithms.
8. Data and Privacy
Our collection, use, and sharing of information is governed by our Privacy Policy. The public sub-processor list lives at /subprocessors.
9. Limitation of Liability
The Service is provided “as is” and “as available.” We make no warranties, express or implied, regarding accuracy, completeness, fitness for a particular purpose, non-infringement, or uninterrupted availability. We are not responsible for the accuracy, legality, or availability of third-party source content.
Because the Service is provided during the beta without charge, our total liability for any claim arising out of or related to the Service during the beta is limited to US $100, to the maximum extent permitted by applicable law. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in those jurisdictions our liability is limited to the greatest extent permitted.
10. Indemnification
You agree to indemnify, defend, and hold harmless Laurel Pines Limited Company, its officers, contractors, advisors, and agents from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of (a) your misuse of the Service, (b) your violation of these Terms or applicable law, or (c) claims by third parties arising from research activities you configured.
11. Service Availability and Modifications
We may modify, suspend, or discontinue any part of the Service at any time during the beta, with or without notice. We explicitly reserve the right to make breaking changes during the beta.
12. Termination
- By you. You may close your account at any time through the in-app settings or by contacting us at the address in §14.
- By us. We may suspend or terminate your account for violation of these Terms, violation of applicable law, or at our discretion during the beta.
- End of beta.The beta period may end at our discretion. We will give at least 30 days’ advance notice of the transition to Sentimentary Corporation under §10A of the Privacy Policy. You may export or delete your data during that notice window.
- Post-termination data. Data deletion timelines follow the retention rules in §6 of the Privacy Policy.
13. Dispute Resolution
- Governing law. These Terms are governed by the laws of the State of Utah, the Service’s principal place of business. Governing law is independent of Sentimentary Corporation’s future charter state, which will be set at incorporation.
- Arbitration. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration in Salt Lake County, Utah, except that either party may bring an individual claim in small claims court if it qualifies.
- Class-action waiver. To the maximum extent permitted by applicable law, you and we each waive the right to participate in a class, collective, or representative action.
14. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us concerning the Service during the beta period.
- Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of that provision.
- Assignment. You may not assign your rights under these Terms without our written consent. We may assign these Terms, including to Sentimentary Corporation at the transition in §12.
- Force majeure. Neither party is liable for delays or failures to perform caused by events beyond its reasonable control.
